This writ petition has been filed by one Dinesh Chandra Sarkar, Singly. The petitioner contends that part of the land acquisition compensation amounting to Rs.6,92,674/- being his share is decided and declared by the jurisdictional Special Land Acquisition Collector, Cooch-Behar has not been paid to him.
Pursuant to the direction made by the coordinate Bench the respondent no.6 has filed a report in the form of affidavit affirmed on August 4, 2023. The petitioner has also filed its exception thereto in the form of affidavit affirmed on September 6, 2023. The same is filed today in Court and is taken on record. The affidavit report filed by respondent no.6 contains the brief decision of the Special Land Acquisition Officer Cooch-Behar, Annexure-A at page 3 thereto. The same reveals that the petitioner's entitlement is
there to the extent of Rs.6,92,674/- in respect of L.R. Plot No.6976 covering the acquired area of 0.0225 acre in so far as the share of this writ petitioner is concerned, this petitioner shall receive payment to the extent of Rs.6,92,674/-.
In view of the above, the respondent no.6 is directed to pay the said sum of Rs.6,92,674/- to the petitioner positively within a period of two weeks from the date of communication of this order, subject to compliance of all formalities by the petitioner. On the above terms this writ petition being WPA 1536 of 2023 stands disposed of, without any order as to costs.
