01.08.2024 Ct. No.02 NB HIGH COURT AT CALCUTTA In The Circuit Bench At Jalpaiguri Appellate Jurisdiction WPA 1479 of 2024 Mahendra Das Vs.

The State of West Bengal & Ors.

Mr. Kumar Shantanu.

...for the petitioner.

Mr. Momenur Rahaman, Mr. Anirban Banerjee.

...for the State.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner was gifted a property by the Government. Surprisingly, a third party sold the said property in favour of some others and the BL&LRO wrongly recorded their names in the RoR. The petitioner made representations before the concerned authorities including the BL&LRO. But no response came.

Learned counsel appearing on behalf of the State submits that the petitioner shall be at liberty to file a formal application before the BL&LRO under the provisions of the West Bengal Land Reforms Act.

It appears that the petitioner has a specific remedy under the concerned Act.

Therefore, the writ petition is disposed of by granting liberty to the petitioner to file a formal application under the provisions of West Bengal Land Reforms Act in this regard.

Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. .
