Learned counsel for the petitioner submits as follows. The petitioner has purchased a property from his neighbor. But, the neighbor is extending his own property in such way as to encroach upon the petitioner's property. He is also violating certain other norms of the Building Laws. Representations in this regard have remained pending.
Learned counsel appearing on behalf of the private respondent denies the allegations and upon instructions,
submits that already an inquiry has been done. No fault could be found on the part of the private respondent. Learned counsel for the Siliguri Municipal Corporation submits that if a representation has been made, the same would be answered in accordance with law.
It appears that two representations of the petitioner alleging violation of Building Laws by a neighbor pending consideration at the Siliguri Municipal Corporation. Let the respondent no.2 consider the said representations of the petitioner in accordance with law and expeditiously, preferably within four weeks from the date of communication of this order after hearing the petitioner and the private respondent. Within a week thereafter, the outcome of such consideration shall be communicated to the petitioner.
With these observations, the writ petition is disposed of.
It is clarified that the merits of the case have not been gone into.
