Mr. Jagriti Mishra Ms. Mrinmayee Das Mr. Manish Gupta ..for the petitioners Ms. Chitra Bhanu Gupta Ms. Supriya Singh ..for respondent Bank Petitioner no.1 retired on 29th February, 2008 as an officer of the Uttarbanga Kshetriya Gramin Bank. Learned advocate appearing for petitioner no.1 submits that the petitioner was given benefit of the first proviso to clause 1 of a circular no.C/35/40/2010-11/CS/156 dated September 2, 2010 and his retiral dues were accordingly revised.

It is the grievance of the petitioner no.1 that errors were made in calculating the arrear gratuity amount of the petitioner in terms of the said circular resulting in a short payment of Rs.2,40,170/-.

The petitioner no.1 submits that despite several representations, the bank has not considered his prayer.

Learned advocate appearing for the bank submits that the aforesaid circular dated September 2, 2010 is not applicable to a retired employee of a bank. He also disputes the amount claimed by the petitioner no.1 as arrear gratuity.

No doubt, there has been a long delay by the petitioner in approaching this Court. However, keeping in mind that the prayer of the writ petitioner concerns the release of his retiral dues, I condone the delay in approaching this Court.

Accordingly, I dispose of this writ petition with a direction upon the General Manager, Uttarbanga Kshetriya Gramin Bank, respondent no.3, to consider the representation of the petitioner dated July 24, 2023 in accordance with law within a period of two months from the date of communication of this order. An opportunity of hearing should be granted to the petitioner no.1 by respondent no.3 before he arrives at his decision. A reasoned order should be communicated to the petitioner no.1 within one week thereafter. Accordingly, WPA 1486 of 2024 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
