1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Petitioner is a primary teacher working in a school in Alipurduar.

Learned advocate representing the petitioner who appears on virtual mode submits that an application for transfer was made on 2nd July, 2025 addressed to the Chairman, Alipurduar District Primary School Council being respondent no. 6 seeking transfer since she is surplus teacher in her present school. It is also stated in the transfer application that distance in between the present school of the petitioner and her place of residence is 85 kilometers. Petitioner has completed five years of confirmed service as primary teacher.

3. State respondents and District Primary School Council, Alipurduar are represented by learned advocates.

4. Having considered the submissions made on behalf of the parties, respondent no. 6 is directed to decide transfer application of the petitioner dated 2nd July, by (eight) weeks from the date of communication of the order. Decision to be taken by the respondent no. 6 shall be communicated to the petitioner by fortnight thereafter.

5. It is made clear that suspension of portal shall not be a ground to reject transfer application of the petitioner.

6. Writ petition stands disposed of.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertaking. 8.
