Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an assistant teacher in a High School. He has prayed for general transfer on the ground of distance. The application was made in the Utsashree portal, but was not considered. By an order dated 20.02.2024 passed in WPA 226 of 2024, this Court directed the respondents authority to consider the prayer for transfer. Pursuant to such order, the Secretary-in-Charge of the West Bengal Central School Service Commission considered the prayer and rejected the same on the ground that the petitioner had chosen only one school at Bally as his preference and his rank was fourth. Thereafter, the petitioner made a representation to
the authorities to allow him to correct the record and keep other options for schools.
Learned counsel appearing on behalf of the Commission submits that in view of the subsequent prayer for correction, let the petitioner make a comprehensive representation in this regard before the School authority which shall be considered in accordance with law, once forwarded by the DI to the Commission.
In view of the above, let the petitioner make a fresh transfer application before the School authorities, within a week from this date. Within a week thereafter, the DI shall forward the same to the West Bengal Central School Service Commission, who in turn, shall consider the application, within five weeks from such date in accordance with law and as expeditiously as possible.
With these observations, the writ petition is disposed of.
