CIRCUIT BENCH AT JALPAIGURI WPA 1508 of 2024 Samchhul Haque -Versus- The State of West Bengal and Ors.

Mr. Satyajit Paul ..for the petitioner Mr. Hirak Barman Mr. Bikash Singha ..for the State It appears that the petitioner, in an earlier round of writ petition, WPA 1468 of 2023 (Samchhul Haque Vs. The State of West Bengal), complained that a portion of his land had been utilised by the relevant Panchayat Samity for construction of a village road but no compensation was paid to him.

A Co-ordinate Bench of this Court while disposing of the said writ petition on August 9, 2023, observed that a portion of the land utilised by the authority had been returned to the petitioner. The said Bench, however, granted liberty to the petitioner to approach the authority to claim compensation for using the land over a certain period.

Learned advocate appearing for the petitioner submits that he has made a representation before the authority in terms of the order passed in WPA 1468 of 2023 on August 9, 2023.

Paragraph 9 of this writ petition suggests that the petitioner made a representation dated March 19, 2024. However, the said representation has not been annexed with the writ petition.

Given this context, I am not inclined to pass any order in this writ petition.

However, I make it clear that the petitioner shall be at liberty to make a representation before respondent no.4 in terms of the order dated August 9, 2024. If such representation is made within a period of seven days from date, the same shall be considered by respondent no.4 in accordance with law.

Accordingly, WPA 1508 of 2024 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
