Mr. Swarup Das ..for the petitioner Ms. Bedashruti Bose Mr. Sumit Kumar ..for the State It appears that the petitioner is an Assistant Teacher at Shilabarihat High School (H.S.), Shilabarihat, Jalpaiguri.
It is the grievance of the petitioner that the relevant police station is not conducting proper investigation following the complaint lodged by him against the private respondents.
It appears that following the complaint lodged by the petitioner, Sitalkuchi Police Station Case No. 417 of 2023 dated December 14, 2023, under Sections 447/323/354/326/307/506(2)/34 of the Indian Penal Code read with Section 4/17 of POCSO Act has been registered.
Learned advocate appearing for the State submits that an investigation is going on and the police found the complaint to be baseless. However, no final report has been filed by the police.
I am of the view that the police are yet to conclude the investigation. If the petitioner is aggrieved by the outcome of the investigation, he is at liberty to take appropriate steps in terms of the relevant provision of Bharatiya Nagarik Suraksha Sanhita. It is open for the petitioner to approach the jurisdictional Magistrate for appropriate relief.
At this stage, I am not inclined to interfere with the investigation.
Accordingly, WPA 1512 of 2024 is dismissed.
