Today, when the revisional is called, no one appears on behalf of the petitioner.

As the copy of the revisional application has not been served upon the State, this Court directs Mr. Nilay Chakraborty, learned Additional Public Prosecutor, to appear on behalf of the State along with a junior of his choice. His appointment along with a junior of his choice, if any, may be regularized by the concerned authority.

The subject-matter of the revisional application relates to quashing of the charge-sheet which has been submitted under Sections 376/511/506 read with

section 8 of the POCSO Act and is pending before the learned Special Judge under POCSO Act-cumAdditional Sessions Judge, Mathabhanga, Cooch Behar. The records of the case reflect that since 03.04.2019, the present petitioner has been evading the court and, consequently, warrant of arrest, proclamation and attachment was issued which was pending till the date of filing of the revisional application.

As the present petitioner, namely, Badal Majumder, is evading the process of law and the documents which have been enclosed are incomplete to assess regarding the merits of the charge-sheet which has been submitted before the learned jurisdictional court, I am of the view that no interference can be made in this revisional application. With the aforesaid observations, CRR 274 of 2024 is Dismissed.
