Antara Chatterjee (Tapaswi) Mr. Atindra Chowdhury ...for the Petitioner This is application wherein the petitioner has prayed for a direction upon the court below for expeditious disposal of the Matrimonial Suit no. 196(8) of pending before the learned Additional District Judge, 1st Court at Siliguri. It is submitted on behalf of the petitioner that on 24th February, 2023, learned court below was pleased to make an attempt for reconciliation of the dispute involved in the suit but it was failed. Thereafter, it was sent to the mediation centre but it was also failed. Thereafter, on 12th December, 2023, the court below was pleased to frame issue but thereafter, the case is pending for adducing evidence by the parties.

Since the prayer made by the petitioner is innocuous and if any, order is passed in terms of the prayer made in the petition, the opposite party will have no cause to prejudice, the service of notice upon the opposite party is hereby dispensed with.

Upon hearing of the learned counsel for the petitioner and also considering the prayer made in the petition which appears to be justified, C.O. 126 of 2024 is hereby disposed of with a direction upon the court below for expeditious disposal of Matrimonial Suit no. 196(8) of 2020 pending before the learned Additional District Judge, 1st Court at Siliguri and to make every endeavour to conclude the entire proceeding preferably within a period of twelve weeks from the date of communication of the order.
