The instant revisional application under Article 227 of the Constitution of India is directed against an order dated July 03, 2025 passed in Misc. Petition Case no. 38 of 2022 under Section 4 of the Maintenance and Welfare of Parents and Senior Citizen Act, 2007.

The mother of the petitioners Smt. Dipti Pramanik had filed an application under Section 4 of the said Act of 2007 before the Sub-Divisional Magistrate, Siliguri. The Magistrate by the order impugned has disposed of the said proceeding with the following directions:- 1.

The petitioner will return to her house by 3(three) days from receipt of this order.

O.P.

will not create any hindrance and will assist the petitioner to vacating the rooms where the petitioner used to live before leaving her property. The petitioner has 0.07 acre of property in her name. That part will not be used by the O.Ps henceforth until and unless the petitioner allows.

If, O.Ps create any nuisance local police will initiate proceeding under Section 126 of B.N.S.S.

2. I.C., Matigara P.S. is directed to render every support to the petitioner so that she can live there peacefully for rest of her life and the interest of the petitioner may not be hampered. He is also directed to maintain peace and

tranquility in and around the area so that no breach of peace will take place.

This Court does not find any reason to interfere with the said directions.

C.O. 152 of 2025 is dismissed without any order as to costs.
