Appellate Side Suman Ct. 01 Rejected CRM (A) 574 of 2025 In re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kotwali Police Station case no.467 of 2024 dated 12.07.2024 corresponding to NDPS Case no.40 of 2024 under Sections 20(b)(ii)(c)/25 of the NDPS Act pending before the learned Additional District Judge, 1st Court (Special Court under NDPS Act) at Jalpaiguri. And In the matter of : Daya Shankar Sharma ... petitioner Mr. Sk. Tasleem Ali Mr. R. Saha ..for the petitioner Mr. Abhijit Sarkar Mr. Bhaskar Das ..for the State.

It appears from the case record that 187 kilograms of ganja was recovered from the vehicle owned by the petitioner.

The record further reveals that, despite the issuance of a notice under Section 67 of the Narcotic Drugs and Psychotropic Substances Act, (NDPS Act), the petitioner failed to appear before the Investigating Officer. It is evident that he remained absconding during the course of investigation. A charge-sheet has since been filed against him.

In view of the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, CRM (A) 574 of 2025 is rejected. Let an urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on the usual undertakings.
