1. The petitioner has made a claim for compensation on account of acquisition land.

2. The learned Advocate for the State submits that the petitioner is not the owner of the land and as such no compensation is payable.

3. The rival contentions of the parties give rise to a dispute which cannot be decided in this proceeding.

4. Thus, the Special Land Acquisition Officer, Cooch Behar shall treat the writ petition as a representation and dispose of the same in accordance with law upon hearing the petitioner and upon appreciating all the documents to be

produced by the petitioner before the authority, at the hearing.

5. A reasoned order shall be passed and communicated. The entire exercise shall be completed within a period of two months.

6. Accordingly, the writ petition is disposed of.

7. There shall be no order as to costs.

8. Parties are directed to act on the basis of the server copy of this order.
