Case No.299 of 2025 dated 11.06.2025 under Sections 137(2)/140(3)/305/3(5) of Bharatiya Nagarik Suraksha Sanhita, 2023 pending before the learned Chief Judicial Magistrate Jalpaiguri.

Learned Advocate for the petitioner submits that the victim left her house out of her own accord. There are no such incriminating materials against this petitioner who happens to be the neighbour of the victim girl. Upon completion of investigation charge sheet has already been submitted. She seeks for grant of anticipatory bail in favour of the petitioner.

Learned Advocate for the State opposes such prayer. 3.

Perused the case diary and the materials on record.

The victim girl in her statement does not implicate this petitioner. Considering the above, I am inclined to allow the prayer of the petitioner for anticipatory bail. 5.

Accordingly, in the event of arrest the petitioner namely Abiya Bibi shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner is directed to cooperate with the Investigating Officer.

This application for anticipatory bail is, thus, allowed. 7.

CRM (A) 580 of 2025 stands disposed of.
