1. Present petition has been filed for grant of anticipatory bail briefly stated that the allegations are that the present petitioner in conspiracy with the co-accused persons forged the record of right and a gift deed in favour of Rita Debi Prasad.

2. Learned counsel for the petitioner submits that the petitioner was merely a witness to the gift deed which was prepared two years ago. Learned counsel,

therefore, submits that the petitioner may be admitted to pre-arrest bail.

3. Learned counsel for the State has opposed the prearrest bail on the ground that the petitioner is in fact a deed writer and he only prepared the deed and also signed as a witness.

4. The facts reveal that the forgery was done in the record on the basis of which property belonging to the deceased father of the de facto complainant was gifted.

5. This Court considers that it is not a fit case for prearrest bail.

6. Thus, the prayer for anticipatory bail of the petitioner is rejected.

7. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
