We are quite surprised that thought the interim order is passed in favour of the petitioner, he feels aggrieved by the same.
Learned advocate appearing for the appellant/writ petitioner submits that the respondent authorities sought to supplement the reason for the
cancellation of the tender issued. Such action is not permissible in the eye of law.
It appears that the learned Judge has only recorded the submissions advanced on behalf of the parties and did not come to any independent finding regarding the merit of the case. It is a settled law that observations made in any interim order are only, prima facie, in nature. Such prima facie findings may not have any bearing on the final adjudication of the writ petition. The learned Judge passed a direction for filing an affidavit by respondent no. 4.
Nothing more requires to be clarified.
Accordingly, MAT 67 of 2025 along with CAN 1/2025 & CAN 2/2025 is dismissed.
