Rejected And In Re : Alongir Miya @ Miah @ Alamgir Miah ..... petitioner Mr. Pawan Gupta Mr. Sudip Guha ...... for the petitioner Mr. Ujjwal Luksom Mr. Tapan Bhattacharjee ...... for the State It is submitted on behalf of the petitioner that he is a GroupD employee of the Gram Panchayat and did not play any role in the crime. He is in custody for 38 days.

Learned lawyer for the State opposes the prayer for bail. He submits petitioner played an active role in forging false birth certificate.

We have considered the materials on record. Statements of witnesses and other incriminating materials show petitioner who is an employee of the Gram Panchayat had forged birth certificate in favour of a co-accused. Investigation is in progress. Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.

Accordingly, the prayer for bail of the petitioner is rejected. ( Ananya Bandyopadhyay, J. ) ( Joymalya Bagchi, J.)
