APP Mr. Aniruddha Biswas ... for the State This application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (in short "BNSS") has been preferred in connection with Sitalkuchi Police Station Case No. 464 of 2024 dated 05.10.2024 under Sections 103(1)/238/61(2) of the BNS, 2023. Mr.

Misra, learned Advocate appearing for the petitioner, submits that the petitioner has been implicated in the alleged offence solely on the basis of the confessional statement of a co-accused. He further submits that the petitioner has been in custody for more than 315 days and that there is no likelihood of an early conclusion of the trial. Accordingly, he prays that, in view of these facts, the petitioner may be enlarged on bail.

Mr. Biswas, learned Advocate appearing for the State, produces the Case Diary and, based on the materials therein, opposes the petitioner's prayer for bail. He submits that the prayer for bail of the present petitioner has been rejected by different Co-ordinate Benches of this Court on several occasions. He further submits that the victim was brutally murdered by the present accused, who had been engaged by the victim's son to carry out the murder of his own father. Heard the learned Advocates representing the respective parties and perused the materials on record, including the Case Diary. Admittedly, the petitioner's prayer for bail has been rejected by different Co-ordinate Benches of this Court even after submission of the charge-sheet. It is the specific case that the present petitioner was engaged by the accused, viz.

, Uttam Singha, son of the victim, to commit the murder of the victim. Therefore, having regard to the extent of the petitioner's complicity in the alleged offence, the nature and gravity of the offence, and the manner in which the offence was committed, I am not inclined to grant bail to the petitioner at this stage. Accordingly, application for bail is, thus, rejected. (Partha Sarathi Chatterjee, J.)
