Devineni Narasimha Pratap Chowdhury And ANR v. State Of West Bengal And ORS.
15.09.2022
IN THE HIGH COURT AT CALCUTTA
Item No.51 CIRCUIT BENCH AT JALPAIGURI Ct.No.2 CRIMINAL REVISIONAL JURISDICTION dc.
C.R.R. 202 of 2022 Mr. Devineni Narasimha Pratap Chowdhury & Anr. versus The State of West Bengal & Ors.
In Re: An Application under Sections 397, 401 and 482 of the Code of Criminal Procedure, 1973.
None appears for the petitioners.
I find that this revisional application was repeatedly called. Records reflect that the same was filed on 31.08.2022. The subject-matter of this revisional application relates to quashing of the proceedings under Section 138 of the Negotiable Instruments Act.
An accommodation has been prayed for on behalf of the counsel whose name does not appear in the four-corners of the application. The advocate-on-record who has signed is also not available. Under the garb of pendency of this revisional application, the trial court proceedings are delayed. Accordingly, I am of the opinion that this revisional application should not be allowed to be pending before the High Court.
Accordingly, the revisional application being CRR 202 of 2022 is dismissed.
All pending connected applications, if any, are consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
