Mr. Sajal Kumar Banerjee ....for the petitioner Mr. Bijoy Bikram Das Mr. Deborshi Dhar ....for the SMC This application has been filed alleging willful and deliberate violation of the order dated April 3, 2024 passed in WPA 2525 of 2024.

After going through the said order, this Court finds that the writ petition was disposed of without granting any relief to the petitioner. No positive direction was passed upon the municipality. However, it was observed that the order shall not prevent the municipal authority from removing encroachment, if any, on the municipal road.

In the event, the petitioner is in possession of any materials in support of the allegation of encroachment upon the municipal road, it will be open to the petitioner to approach the Municipality for consideration in accordance with law.

With the above observation CPAN 48 of 2025 stands disposed of.
