By these writ petitions petitioners have sought relief of direction upon the respondents/ authorities concerned to disburse the interest amount towards gratuity and arrears pension amount in question from the date of death of the pensioners or date of retirement of the pensioners till the date of actual date of payment/disbursement along with interest to the petitioners. Petitioners submit that the issues involved in these writ petitions are directly covered by the several decisions of this Court partucularly in the case of Bidyut Kolya -vs- The State of West Bengal & Ors. in WPA 9787 of 2022 and in the case of Manu Mistry Chhetri -Vs- The State of West Bengal & Ors. in WPA 1319 of 2021.
Considering the submission of the parties, these writ petitions being WPA 2500 of 2022 as well as WPA 2501 of 2022, WPA 2502 of 2022, WPA 2503 of 2022, WPA 2504 of 2022, WPA 2505 of 2022, WPA 2506 of 2022, WPA 2509 of 2022, WPA 2510 of 2022, WPA 2512 of 2022, WPA 2513 of 2022, WPA 2514 of 2022, WPA 2515 of 2022, WPA 2516 of 2022, WPA 2518 of 2022 are disposed of by directing the respondents/authorities concerned to pay to the petitioners interest on gratuity and arrear pension in question with interest at the rate of 8 % p.a. to be
calculated from the date when the aforesaid arrear in question became due till the date of such disbursement.
With the observation and direction made above all these writ petitions are disposed of.
Learned advocates appearing for the state respondents submit that no copies of the writ petitions have been served upon the respondents. If the copies of the writ petitions are not served upon the learned advocates appearing for the State respondents by 7th November, 2022 in that event this order shall not have any force.
