This is an appeal directed against an judgment and decree dated 17th May, 2023 alongwith 29th May, 2023 passed by the Learned Civil Judge (Senior Division), Sadar at Cooch Behar in Title Suit No. 13 of 2022.

By the impugned judgment, the suit has been dismissed alongwith costs. The order sheet reflects that the matter had repeatedly adjourned on 25th September, 2024, 22nd January, 2025 and 21st May, 2025 respectively before this Court.

It is obvious that the appellant is neither serious nor diligent in proceeding with this lis. In view of the repeated non-appearance of the appellant, FAT/28/2024 stands dismissed for default.
