The petitioner is an Assistant Teacher at Mathabhanga Mangilal Bhadani Hindi High School in Coochbehar. He made an application before the relevant District Inspector of Schools for his transfer to any School in Jalpaiguri. The District Inspector of School Coochbehar rejected the prayer on the ground that the petitioner is the "single teacher of the subject".

In my considered opinion the case of the petitioner should be considered afresh by the said District Inspector of Schools in light of the subsequent memo dated 03-01-2022 issued by the School Education department. The said memo delineates the circumstances under which even a single teacher can seek transfer.

In view of the above, this writ petition is disposed of with a direction upon the concerned District Inspector of Schools to consider the case of

the petitioner in light of the aforesaid Circular dated 3rd January, 2022 within a period of one month from date and to take follow up action should the petitioner be deemed eligible for a transfer. Accordingly, WPA 1831 of 2023 is disposed of. (KAUSIK CHANDA, J.)
