1. It is the grievance of the plaintiffs/petitioners that their application under Section 151 CPC as filed in Title Suit No.709 of 2024 as pending before the learned Civil Judge (Junior Division), Jalpaiguri is pending for a considerable length of time.
2. It is submitted that the next date is fixed on 25th August, 2025 for further hearing of the said petition under Section 151 CPC as well as the injunction application as filed by the plaintiffs/petitioners.
3. It is made known to this Court that as against the injunction application as filed by the plaintiffs/petitioners herein, the defendants/opposite parties herein have already filed written objection.
4. In view of such, this Court while disposing the instant revisional application directs the learned Trial Court to dispose of the injunction application as filed by the plaintiffs/petitioners as well as the
application under Section 151 CPC positively by the last day of August 2025.
5. The time limit as fixed by this Court is mandatory and preemptory.
6. Liberty is given to the learned advocate-on-record for the plaintiffs/petitioners to communicate the server copy of this order to the learned Trial Court.
7. The learned Trial Court is hereby directed to act on the basis of the server copy of this order.
8. Before parting with, the department is also directed to forward a copy of this order to the learned District Judge, Jalpaiguri, who on receipt of the same shall ensure the order as passed by this Court duly complied with by the learned Trial Court in letter and spirit.
9. With the aforementioned discussions, CRR 166 of 2025 is disposed of.
10. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities. (Partha Sarathi Sen, J.)
