This revisional application was earlier called when none appeared for the petitioner. The subject-matter of this revisional application relates to Misc. (Judicial) Case No. 1 of 2022.

The records of the case reflect that the learned Additional District and Sessions Judge, 2nd Court, Siliguri by a reasoned order dated 16.08.2022 dismissed the application under Section 340 of the Code of Criminal Procedure. Ordinarily an appeal should lie against an order of refusal under Section 340 of the Code of Criminal Procedure. On appreciation of the fact, which has been narrated and the order passed, I am of the opinion that the present revisional application preferred before this Court is wholly misconceived.

Accordingly, the revisional application being CRR 207 of 2022 is dismissed.

All pending connected applications, if any, are consequently disposed of.
