Mr. Hillol Saha Podder Ms. Mousumi Das ..for the petitioner Mr. Abhijit Sarkar Mr. Kallol Nag ..for the State The petitioner has been apprehended solely on the basis of the statement made by a co-accused. He has remained in custody for over 52 days. Despite the passage of this period, the Investigating Agency has not collected any material to independently corroborate the statement of the co-accused. In view of the aforesaid circumstances, the prayer for bail is allowed.
Accordingly, it is directed that the petitioner, namely Ashish Sarkar, shall be released on bail upon furnishing a
bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of like amount each, one of whom must be a local resident, to the satisfaction of the learned Additional Sessions Judge, 1st Court-cum-Special Court under the NDPS Act, 1985. The petitioner shall report to the Investigating Officer once in a fortnight until the charge-sheet is filed and shall not, in any manner whatsoever, intimidate witnesses or tamper with evidence.
In the event the petitioner fails to comply with the condition, the Trial Court shall be at liberty to cancel his bail in accordance with law, without further reference to this Court. Accordingly, CRM (NDPS) 337 of 2025 is, thus, disposed of.
Let an urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on the usual undertakings.
