Mr. Bikramaditya Ghosh, Ms. Supriya Singh ..for the petitioner Mr. Subir Kumar Saha, Mr. Bikash Singha ...for the State The petitioner is presently working as a Librarian at Alipurduar University constituted under the Alipurduar University Act, 2018.

By the aforesaid enactment, Alipurduar College was converted into Alipurduar University. Section 64 (3) of the Alipurduar University Act, 2018, provided an option for the teaching and non-teaching staff of the then Alipurduar College either to continue their service with Alipurduar University or to seek transfer to any other Government aided College.

Learned advocate appearing for the petitioner submits that the petitioner had opted for transfer to a Government aided College.

The prayer of the petitioner was forwarded to the Director of Public Instruction, West Bengal, by the

Registrar of the University by a letter dated January 11, 2023, and thereafter again on July 8, 2024. The petitioner submits that till date, the Director of Public Instruction, West Bengal has not considered the prayer. In the aforesaid facts, this writ petition is disposed of with a direction upon the Director of Public Instruction, West Bengal to consider the prayer of the petitioner for transfer on the basis of the letters dated January 11, 2023 and July 8, 2024 as expeditiously as possible preferably within a period of one month from the date of communication of this order.

WPA 1817 of 2024 is disposed of.
