This revisional application is directed against an order dated 12 August, 2024 in Misc. Appeal no. 46/2024, whereby a direction to show cause was issued and the application for temporary injunction was posted for hearing without granting an order of injunction.

On behalf of the petitioner, it is fairly submitted that since no ad interim order has been passed, no purpose would be served in this application being kept pending. The petitioner prays for liberty to proceed before the Trial Court in accordance with law.

In view of the submissions made on behalf of the petitioner, the instant petition has for all purposes been rendered infructuous.

CO/138/2024 stands disposed of by granting liberty to the petitioner to proceed expeditiously

with the interlocutory application pending before the District Civil Judge (Junior Division) at Jalpaiguri.

Liberty is granted to the petitioner to pray for appropriate reliefs before the Trial Court. It is made clear that there has been no adjudication on the merits of the case.
