IN THE HIGH COURT AT CALCUTTA

Circuit Bench at Jalpaiguri CIVIL APPELLATE JURISDICTION

Present:

The Hon'ble Justice Joymalya Bagchi And The Hon'ble Justice Ajay Kumar Gupta M.A.T. 124 of 2023 with CAN 1 of 2023 with CAN 2 of 2023 Manoj Kumar Barman -Vs- The State of West Bengal and Ors.

For the Appellant :

Mr. Ratan Chandra Roy, Adv.

For the respondents :

Mr. Subir Kumar Saha, Adv.

Mr. Momenur Rahaman, Adv.

Heard on :

14.05.2024 Judgment on :

14.05.2024 Joymalya Bagchi, J. :- 1.

Appellant/writ petitioner had approached this Court in WPA 635 of 2022 seeking direction upon Director of Public Instruction to take a decision in the 'matter of grant of benefits in terms of Memorandum No. 2081-Edn. (CS)/10M-83/2019 dated 23.12.2019. In terms of the direction given by this Court the Director of Public Instruction passed a

reasoned order. This came to be challenged in the present writ petition. Learned Single Judge observed that order was a well reasoned one and did not call for interference.

2.

I have perused the impugned order. It is recorded in the order that the appellant/writ petitioner was not appointed in the concerned college through a valid selection process. No resolution was taken by the governing body in that regard. He was orally requested to serve as an invited speaker from April, 2019 to March, 2020. In view of the aforesaid finding respondent authority held that appellant was not entitled to the benefits under the aforesaid Memorandum. I do not find any illegality in the impugned decision.

3.

Appeal being MAT 124 of 2023 is accordingly dismissed. Connected applications being CAN 1 of 2023 and CAN 2 of 2023 are also disposed of.

4.

There shall be no order as to costs.

I agree.
