Mr. Aditi Shankar Chakraborty, APP, Ms. Namrata Das ... For the State. The petitioner is in custody for almost 100 days. It is submitted that he has been falsely implicated and the FSL report has not yet been disclosed.

The learned Additional Public Prosecutor appearing on behalf of the State opposes the prayer for bail and submits that the petitioner is the main accused and the injury report shows that due to acid attack, both eyes of the victim are heavily damaged and there shall be probability that the victim may be blind and her future blindness cannot be ruled out.

Considering the materials, nature and gravity of the offences, we are not inclined to release the petitioner on bail at this stage. Accordingly, the prayer for bail stands rejected.

However the learned A.C.J.M., Jalpaiguri is directed to take consequential steps and to commit the matter to the appropriate Court for the following formalities.
