Mr. Shubhankar Dutta ...for the Petitioner Mr. Subir Kumar Saha, Mr. Momenur Rahman ...for the State It has been alleged by the petitioner that he is a victim of the post poll violence that took place after the Assembly election of the State held in the year 2021. The petitioner claims that he has a book shop at Gosanimari under Dinhata Police Station which was ransacked and vandalised by the private respondents. He further submits that despite several complaints being made, no step was taken by the State authorities against the private respondents.

Further grievance of the petitioner is that the said private respondents are also obstructing the petitioner to repair his book shop.

Mr.

Momenur Rahman, learned advocate appearing for the State submits that following the complaints made by the petitioner, an investigation was carried out by the police and a charge sheet has been

filed against the private respondents under Sections 143/448/427/435/382 of the Indian Penal Code, 1860. Having regard to the facts as indicated above, I dispose of the writ petition giving a direction upon the Officer-in-Charge, Dinhata Police Station to provide adequate protection to the petitioner so that he can repair his book shop and run his business peacefully without any disturbance from the private respondents. With the aforesaid directions, writ petition being WPA 2559 of 2022 is disposed of.
