Petitioners Mr. Hillol Saha Podder For the Petitioners Mr. Abhijit Sarkar Ms. Namrata Das For the State The learned Counsel for the petitioners submits that there have been cases and counter-cases between the parties and the petitioners have been falsely implicated in the instant case.
The learned Counsel for the State produces the case diary and opposes the prayer for anticipatory bail.
Considering the materials available on record and the nature and extent of involvement of the petitioners in the commission of the alleged offence and in view of the fact that there no injury, we are inclined to grant anticipatory bail to the petitioners.
Accordingly, we direct that in the event of arrest the petitioners, namely, Niranjan Barman and Biplab Barman, shall be released on bail upon furnishing a bond of Rs.10,000/-each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 438(2) of the Code of
Criminal Procedure, 1973 and on condition that the petitioners shall meet the IO once in a week until further orders.
The prayer for anticipatory bail is allowed and CRM 1148 of 2021 is accordingly, disposed of.
