24.09.2024 S.D.
C.R.M.(DB) 458 of 2024 In Re:- An application for cancellation of bail under Section 439 (2) of the Code of Criminal Procedure, 1973. And In Re : Manio Oraon ...... petitioner Mr. jaydeep Kanta Bhowmik Mr. Shubham Kumar Ms. Sayantani Das Mr. Jasmin Haque ...for the petitioner Mr. Aditi Shankar Chakraborty, Ld. A.P.P., Ms. Namrata Das .... for the State Post bail misconduct is a ground canvassed for the purpose of cancellation of bail granted by the Order No. 3 dated June 6, 2024 passed in Sessions Case No. 145 of 2024 by the learned Sessions Judge.
Learned advocate appearing for the petitioner submits that, the opposite parties after obtaining the order of bail continuously threatened the defacto complainant. Two police complaints were lodged in this regard.
Noticing such submissions, we requested learned Advocate for the State to take instructions yesterday. Learned advocate for the State submits a report which be kept on record.
Report speaks of two police complaints being received by the police. First one resulted in a proceeding under Section 107
of the Cr.P.C. The other was found to be contradictory in nature.
Police took steps on the basis of the two complaints lodged by the petitioner.
The nature of the incidents subsequent to the grant of bail are not that serious so as to cancel the bail granted to the private opposite parties.
In such circumstances, C.R.M. (DB) 458 of 2024 is dismissed without any order as to costs.
This order will not prevent the petitioner from approaching afresh if the incident complained of proceeds or or any other ground.
