The petitioner says that he has been falsely implicated. He is 20 years of age and the victim lady is 62 years of age. He did not even attempt to commit rape on the victim. The allegations of having used force against the victim or having inflicted injury on her are all false. The false allegations have been prompted by there being rivalry between the two families regarding land disputes. He is in custody for 211 days. Chargesheet has been filed. No useful purpose would be served by keeping him in custody any further. He prays for bail.
We have seen the material in the case diary including the Medical Report and the statement of the lady. The allegations are of rape, inflicting grievous bodily injury and attempted murder. They are all serious allegations. The material on record prima facie indicates that there could be active involvement of the petitioner in the alleged offence. In view of the aforesaid, although the petitioner has been in custody for about 211 days, we are not inclined to entertain the petitioner's prayer for bail, at this stage. The application for bail is, accordingly, rejected. CRM 1151 of 2021 is dismissed.
