Learned counsel for the petitioner submits that co-accused Ajay Yadav was granted bail by the Co-ordinate Bench of this Court on 14th August, 2025. Learned counsel submits that in fact the present petitioner was petitioner no.2 in CRM (NDPS) 252 of 2025. However, inadvertently the bail of the present petitioner was not pressed.

Learned counsel for the State has fairly submitted that the allegations against the present petitioner are identical as to the co-accused Ajay Yadav. Co-accused Ajay Yadav was granted bail

by the Co-ordinate Bench of this Court and it was, inter alia, held as under :

"The police report, filed, today, suggests that the transporter possessed all valid documents, including GST invoices and e-way bills. It is not disputed that the consignor holds a valid medical license, and the consignee also holds a valid medical license. It appears that at the time of unloading, petitioner no.1 was unable to produce these documents. However, the relevant documents were later produced before the police. The police report filed before this Court clearly suggests that the transportation was carried out with all the necessary valid documents, including GST invoices and e-way bills.

In light of this, the present application for bail is allowed." 3.

Taking into account the facts and circumstances, the application for bail is allowed.

Accordingly, it is directed that the petitioner shall be released on bail upon furnishing a bond of Rs.50,000/- (Rupees Fifty Thousand Only), with two sureties of the same amount, one of whom must be local, to the satisfaction of the learned Additional Sessions Judge, 1st Court (NDPS), Coochbehar. This is subject to the condition that the petitioner shall appear before the Trial Court on every date of hearing until further orders, and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event that the petitioner fails to appear before the Trial Court without justifiable cause, the Trial Court shall be at liberty to cancel his bail in accordance with the law, without further reference to this Court.

Accordingly, C.R.M.(NDPS) 345 of 2025 stands disposed of.
