(NDPS) 350 of 2025 In Re:- An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with NDPS Case no. 74 of 2025 arising out of Falakata Police Station Case No. 213 of 2025 dated 29.04.2025 under Sections 21(c) of the NDPS Act, 1985. And In the matter of : Rabiul Islam .... Petitioner.

Mrs. Juin Dutta Chakraborty ...for the Petitioner Mr. Nilay Chakraborty Mr. Aniruddha Biswas ...for the State Prosecution case is that huge quantity of contraband substance was recovered from the joint possession of the present petitioner and one Anima Majumder. Prosecution further case is that bail prayer of the co-accused Anima Majumder has been rejected by this Court in CRM (NDPS) 348 of 2025. Prosecution further case is that petitioner has criminal antecedent and he has been implicated with three other similar type of cases.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is in custody since 29th April, 2025 and investigation has already been completed and considering his period of detention he may be released on bail on any terms and conditions.

Having heard learned counsel appearing on behalf of both the parties and that the petitioner has criminal antecedent and huge quantity of contraband substance was recovered from the joint possession of the present petitioner, I find that the petitioner has failed to overcome the restrictions imposed in Section 37 of the NDPS Act, and as such the prayer for bail made by the petitioner stands rejected. Accordingly, CRM (NDPS) 350 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
