CIRCUIT BENCH OF CALCUTTA HIGH COURT 17.12.2021 AT JALPAIGURI Court No.01 Item No. 31 sg CRM 1163 of 2021 (Via Video Conference) In Re:- An application for anticipatory bail under section 438 of the Code of Criminal Procedure in connection with Dhupguri Police Station Case No. 474 of 2020 dated 13.12.2020 under Sections 498A/306/34 of the Indian Penal Code. And In Re: Madhu Sarkar & Anr.

Petitioners Mr. Arijit Ghosh For the Petitioners Mr. Kallol Acharjee Ms. Namrata Das For the State In view of the submissions made on behalf of the Counsel for the respective parties that the petitioners stand on the same footing as that of Dilip Sarkar who was granted anticipatory bail by a coordinate Bench on 20th July, 2021, we allow this application for anticipatory bail on the same terms and conditions.

Accordingly, we direct that in the event of arrest the petitioners, namely, Madhu Sarkar and Robi Sarkar @ Rabi Sarkar @ Noni Sarkar, shall be released on bail upon furnishing a bond of Rs.10,000/- each , with two sureties of like amount each, to the satisfaction of the arresting officer of the concerned police station and on condition as laid down under Section 438(2) of the Code of Criminal Procedure and on further condition that the petitioners shall meet the Investigation Officer once in a week.

The prayer for anticipatory bail is allowed and CRM 1163 of 2021 is accordingly, disposed of.
