Learned counsel for the petitioner submits that no recovery has been effected from the present petitioner. He further submits that only the name of the petitioner had appeared in the disclosure statement of four accused persons. Learned counsel further submits that the persons from whom recovery was effected have already been admitted to bail by the learned Trial Court.

Learned counsel for the State has also fairly submitted that the name of the present petitioner has only appears in the disclosure statement of accused persons. Admittedly, the quantity of contraband recovered from the possession of co-accused person is

an intermediate quantity. The only evidence against the petitioner is the statement of the co-accused persons. Admittedly, the petitioner has no criminal anticident.

Taking into consideration of the facts and circumstances of this case petitioner is directed to join investigation as and when directed by the I.O. In the event, if Investigating Officer feels necessary of effecting the arrest of the petitioner, the petitioner be admitted to anticipatory bail by furnishing personal bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of like amount each, one of whom shall be local, to the satisfaction of the Investigating Officer, subject to the conditions that he shall join and cooperate in the investigation as and when directed by the Investigating Officer and shall not threaten, tamper or intimidate the complainant or members of the family in any manner. The application for anticipatory bail is thus disposed of.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
