(NDPS) 358 of 2025 In Re:- An application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with PTN case no. 502 of 2025 arising out of Pundibari Police Station case no. 407 of 2025 dated 4.5.2025 under Sections 20(b)(ii)(c)/25/29 of the NDPS Act 1985. And In the matter of : Osman Ali .... Petitioner Mr. Satyajit Paul ...for the Petitioner Mr. Abhijit Sarkar Mr. Tapan Bhattacharjee ...for the State Prosecution case is that on 4.5.2025, the narcotic substance weighing total 27.185 kgs. were recovered from the possession of the present petitioner. He is in custody since 4th May, 2025. The investigation is still in progress. Learned counsel for the petitioner prays for bail considering his period of detention.

Learned counsel for the State opposed the prayer for bail contending that commercial quantity of narcotic substance was recovered from the possession of the present petitioner. He further submits that the petitioner has criminal antecedent being Kotwali Police Station case no. 522 of 2022 dated 20th May, 2022 under Section 21(C) of the NDPS Act.

Having considered the submissions made on behalf of both the parties and also considering the materials placed before me, it appears that the petitioner has failed to overcome the rigour of Section 37 of the NDPS Act in the instant case and as such, the prayer for bail made by the petitioner is rejected.

Accordingly, CRM (NDPS) 358 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
