IN THE HIGH COURT AT CALCUTTA
CIRCUIT BENCH AT JALPAIGURI CRIMINAL MISCELLANEOUS JURISDICTION C.R.M. (M) 243 of 2025 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Kalimpong Police Station Case No. 158 of 2022 dated 09.06.2022 under Sections 323/506 of the Indian Penal Code read with Section 6 of the POCSO Act.
And In Re : Tshering Dorji Bhutia @ Tshering Dorjee Bhutia & Anr. Mr. Satyajit Paul Mr. Mayank Bhandari Mr. Rajan Raj ... For the Petitioners Mr. Aditi Shankar Chakraborty Mr. Tapan Bhattacharjee ... For the State The petitioners are in custody for more than three years and pray for bail.
Learned counsel for the petitioners submits that out of 16 witnesses 15 witnesses have been examined. The witnesses have not corroborated the contention of the victim. Learned counsel for the State opposes the prayer and submits that evidence shall be concluded within two months from the next date fixed before the learned trial Court subject to cooperation by the petitioners and systemic reasons. I have considered the material on record.
In view of the nature and gravity of offence and also since the trial is at its fag end, prayer for bail is rejected at this stage.
Learned trial Court is directed to expedite the trial and take the same to its logical conclusion in the light of the submission made on behalf of the State.
CRM (M) 243 of 2025 is disposed of.
