1. Learned counsel for the petitioner submits that only allegation against the petitioner is under 14C of the Foreigners Act, 1946. Learned counsel submits that identical placed accused Harendra Roy @ Harendra Nath Roy was admitted to pre-arrest bail by the learned Sessions Court.

2. Learned counsel for the State submits that the present petitioner has abated the offence under Section 14A of the Foreigners Act.

3. Admittedly, the petitioner is an Indian national.

4. Accordingly, the prayer for anticipatory bail of the petitioner is allowed.

5. Taking into account, in the event of arrest, the petitioner be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438 (2) of the Cr.P.C., 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner shall not threaten or intimidate or tamper with the witnesses and the petitioner shall join the investigation as and when directed by the Investigating Officer.

6. CRM (A) 642 of 2025 is disposed of.

7. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
