06.01.2022 Ct. No.2 suman CIRCUIT BENCH OF CALCUTTA HIGH COURT AT JALPAIGURI (Via Video Conference) CRR 177 of 2021 Amina Begum Vs.

Abul Kalam Haque and others Mr. Anirban Banerjee ..for the petitioner Plight of the petitioner for failure on the part of the learned trial Court to dispose of an application under Section 12 of the Protection of Women from Domestic Violence Act, is not at the door of this Court. It is submitted by Mr. Banerjee, learned advocate for the petitioner that the application under Section 12 of the said Act is pending since 2016. The petitioner only prays for expeditious disposal of her case. This Court is of the view that the matter can be disposed of even without directing the petitioner to serve copy of the instant revision to the opposite parties. This Court is allowing to the cause of the petitioner. The petition under Section 12 of the said Act ought to be disposed of as early as possible and it is not at all a healthy picture to see such proceeding

pending since 2016. At the same time it is within the knowledge of the learned Advocate that due to sudden surge of Covid cases in the State of West Bengal, daily hearing of the matters is suspended for the time being. In view of such circumstances, the instant revisional application is disposed of directing the learned Trial Judge to dispose of the proceeding under Section 12 of the said Act filed by the petitioner within three months from the date of normalization of the situation and regularization of daily work of Court proceedings.

The instant revision, is, thus, disposed of.
