Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case only on the basis of the fact that petitioner happens to be owner of the vehicle. According to the petitioner, the vehicle was sold to one Priom Rai who was caught red-handed by the police authorities with contraband and consequent to which the present case was registered. According to the petitioner, he is innocent of the charges and the subsequent return of the vehicle in favour of Priom Rai would also lead to the fact that the petitioner has neither any interest for the vehicle nor the materials on which the prosecution has presented its case substantiate any of the accusations.
Learned advocate for the State has produced the case diary.
I find from the case diary that till date, the name of the vehicle owner has been registered in favour of the petitioner. The documents which have been relied upon by the petitioner to emphasize relating to transfer of the vehicle are not of impeccable character to accept its admissibility under the Evidence Act without the same being tested on dock. Consequently, I am of the view that the order passed by the learned Trial Court do not call for any interference. As such, the revisional application being CRR 323 of 2024 lacks merits and is dismissed.
Case diary be returned to the learned advocate appearing for the State.
Pending connected application, if any, is consequently disposed of.
