Learned counsel for the State submits that the petitioners have duly been named by the de facto complainant in her initial complaint as well as in the supplementary statement and statement under Section 164 Cr.P.C. learned counsel for the State has also placed reliance upon the injury report. 2.
Learned counsel for the petitioners submits that in fact it was a dispute between husband and wife as allegedly Dewan Limbu husband of the de facto complainant assaulted her. Learned counsel submits that however latter on the matter was
settled husband Dewan Limbu had already been admitted to bail.

Perusal of the record indicates that it was a dispute between de facto complainant, i.e., wife and her husband coaccused Dewan Limbu. The de facto complainant though has named the petitioners in her complaint, however, now since the charge-sheet has already been filed.

The court considers that be admitted to bail, the petitioners be released on anticipatory bail on furnishing a personal bond of Rs.10,000/- (Rupess Ten Thousand Only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned ACJM, Siliguri, subject to the conditions that they shall join the investigation as and when directed the Investigating Officer and shall not threaten, intimidate or tamper the witness in any manner whatsoever. 5.
The application for anticipatory bail is thus, disposed of. 6.
Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
