Calcutta High Court In the Circuit Bench at Jalpaiguri Appellate Jurisdiction W.P.A 2525 of 2021 (Via Video Conference) Sumati Roy -versus State of West Bengal & Ors.

Mr. Saktipada Jana, Mr. Debajit Kundu.

...For the Petitioner.

Mr. Bikramaditya Ghosh, Mr. Momenur Rahman.

...For the State.

The petitioner is the widow of a deceased primary school teacher. Her grievance is that the terminal benefits of her husband have not been released till date. The teacher superannuated on 31st March, 2009 and expired on 30th May, 2018.

Learned advocate for the petitioner relies upon a communication dated 31st December, 2021 made by the District Inspector of Schools (Primary Education), Jalpaiguri to the Director of Pension, Provident Fund & Group Insurance, West Bengal, wherefrom it appears that the District Inspector of Schools (Primary Education) forwarded the pension papers of late Goy Chandra Roy, retired headmaster of Rakhalhat BFP School under Mayanaguri Circle, District Jalpaiguri for according sanction.

As it appears that the District Inspector of Schools (Primary Education), Jalpaiguri already

forwarded the pension papers of the deceased teacher to the office of the DPPG, accordingly, the instant writ petition is disposed of by directing the respondent no. 5 to take necessary steps pursuant to the aforesaid communication being Memo No. 643/Pen dated 31st December, 2021 strictly in accordance with law, at the earliest, but positively within a period of ten weeks from the date of communication of a copy of this order. The writ petition stands disposed of.

Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
