The petitioner is a widow of a deceased school teacher. The teacher died in harness on 31st July, 2020. Her grievance is that the respondent authority is not disbursing the family pension in her favour and also not granting ancillary benefits viz., enlistment of her name in the live roster for compassionate appointment. The petitioner submitted a representation before the respondent authorities on 23rd October, 2021 and alleges that the same has not been considered till date. Learned advocate for the State respondent is not ready with the instructions as to why the pension has not been released in favour of the petitioner. As it appears that the representation filed by the petitioner praying for the terminal benefits as well as her prayer for providing appointment on compassionate

ground is pending consideration at the end of the respondent authority, no useful purpose will be served by keeping the writ petition pending.

The instant writ petition is disposed of by directing the District Inspector of Schools, Cooch Behar being the respondent no. 4 herein to take necessary steps for processing the pension papers of the deceased teacher as well as to consider the prayer of the petitioner for grant of compassionate appointment in her favour strictly in accordance with law, at the earliest, but positively within a period of twelve weeks from the date of communication of a copy of this order. The said respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter. The said respondent shall take all necessary steps to disburse the dues of the deceased teacher in favour of the widow at the earliest. The writ petition stands disposed of.

Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
