The petitioner's application seeking transfer on medical ground of his child is pending consideration at the end of the respondent authority.

On a perusal of the documents annexed to the writ petition, it appears that the writ petitioner applied before the Teacher-in-Charge of the subject school for transfer. The said application is yet to be forwarded to the District Inspector of Schools.

None represents the school authority.

Without the application being forwarded to the District Inspector of Schools, the State respondents will not be in a position to act.

In view of the above, the Teacher-in-Charge, Keshari Bari High School being the respondent no. 5 herein is directed to forward the application filed by the petitioner seeking transfer to the District Inspector of

Schools (Secondary Education), Cooch Behar to take necessary follow up steps in accordance with law. The report from the Medical Board shall be obtained by the District Inspector of Schools. In the event the aforesaid respondent is of the opinion that the petitioner may be transferred, then necessary consequential steps shall be taken in the matter.

The Teacher-in-Charge of the School is directed to forward the application of the petitioner to the District Inspector of Schools at the earliest but positively within a period of seven days from the date of communication of this order.

The District Inspector of Schools shall proceed to dispose of the application within a period of twelve weeks thereafter.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties upon compliance of usual legal formalities.
