Affidavit of service filed in Court today, is taken on record. The petitioner praying for transfer on distance ground as would be evident from the averment made in paragraph 3 to the writ petition. The necessary offline application is available at page 84 to the writ petition submitted before the present school.
In view of the above, the present school authority shall consider the said application and then with all its relevant record and the necessary 'no objection' shall transmit and send the same before the jurisdictional District Inspector of Schools.
This entire exercise shall be carried out and completed by the school authority positively within a period of two weeks from the date of the communication of this order.
The jurisdictional District Inspector of Schools after receiving the said records from the school authority shall take steps in accordance with law but positively within a period of four weeks from the date of receiving the records from the school.
It is needless to mention that, at every stage the appropriate authorities shall take steps and decide the issue strictly in accordance with law.
The decision shall be communicated to the petitioner within a period of four weeks from the date of the steps to be taken by the jurisdictional District Inspector of Schools. In the event of rejection, the reasons shall also be communicated to the petitioner in writing within the said period of four weeks.
This order shall not create any right or equity in favour of the petitioner and the authorities shall take steps strictly in accordance with law. Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents. With the above observations and directions this writ petition W.P.A. 1852 of 2025 stands disposed of, without any order as to costs. Photostat certified copy of this order, if applied for, be furnished expeditiously.
