Affidavit of service filed in Court today, is taken on record. Mr. Shuvro Prokash Lahiri, learned Advocate appears for the petitioner.
Mr. Pretom Das, learned Advocate with Mr. Sourav Sarkar, learned Advocate appears for the respondents State.
Mr. Sunit Kumar Ray, learned Advocate appears for the respondent School Service Commission.
Mr. Shuvro Prokash Lahiri, learned Advocate for the petitioner submits that the petitioner as an Assistant Teacher seeks transfer from the present school to another. The present school has submitted its "No Objection" at page 91 to the writ petition before the jurisdictional D.I. At that stage the petitioner is stuck.
In view of the above, the respondent no.5/ D.I. is directed to consider the application of the petitioner on the basis of the records sent by the present school to him and to take a reasoned decision thereupon in accordance with law.
The exercise shall be carried out by the jurisdictional D.I. positively within a period of six weeks from the date of communication of this order. In the event, the reasoned decision of the D.I. goes in favour of the transfer then all necessary and consequential steps shall be taken by the jurisdictional D.I. and the appropriate authority in accordance with law within a period of four months from the date of the decision of the D.I. Since affidavits are not called for, the allegation made in this writ petition are deemed not to have been admitted by the respondents. With the above observations and directions, the writ petition, WPA 1853 of 2025 stands disposed of, without any order as to costs. Parties shall act on the server copy of this order duly downloaded from the official website of this Court.
