The petitioner is a retired secondary school teacher. He alleges that he has been paid the CPF amount contrary to the provisions of the notification dated 13.06.2014.

It appears that the petitioner lodged a formal complaint before the Head Master of the school in question with a copy marked to the State respondents. There is no proof of service of the aforesaid objection upon the State respondents.

In view of the above, the instant writ petition is disposed of by granting leave to the petitioner to approach the District Inspector of Schools (Secondary Education), Jalpaiguri with his prayer.

In the event such representation is made giving details of the illegalities committed at the time of calculation of the CPF amount, then the District Inspector of Schools shall consider the same in accordance with law in light of the relevant notification

and the prevailing law and take necessary consequential steps to remedy any error that may have cropped in. Steps shall be taken in the matter at the earliest but positively within a period of twelve weeks from the date of communication of this order.

If any error is detected, then the amount shall be transmitted to the petitioner along with simple interest at the rate of 7% per annum to be calculated on and from the due date till the date of actual payment. Affidavit-of-service filed today in court be kept with the records.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties upon compliance of usual legal formalities.
